OF has no rules about it afaik as long as creator consented. The thing no one has the answer of is, did the "creator" of the fake consent to it being sold? and the fact if she didn't consent to it being made, but he probably consented to her selling it or even offered her to sell it
It's likely he could have some claim due to the usage of his likeness. There's been a lot of legal development in the field of likenesses as intellectual property in recent years - at least around athletics.

Obviously, the artist cannot sell the art they made of Lebron James that would be an issue. Lebron cannot sell someone else's art even if it is a drawing of him without the artist's consent or without giving them a cut.
